These general terms and conditions of sale (the “Terms”) govern the purchase of products from La Boutique Il San Pietro di Positano through its dedicated e-commerce platform and form an integral part of every sales contract concluded online with SAN PIETRO S.P.A. Before submitting an order, the Customer is invited to read them carefully and retain a copy. The Return and Refund Policy and the Shipping and Delivery Policy published on the Website supplement these Terms in relation to their respective subject matters.
1. Scope and definitions
These Terms apply to distance sales concluded through the Website between the Seller and the Customer. “Customer” means the person placing the order; where the Customer acts for purposes unrelated to their business, trade, craft or professional activity, they qualify as a “Consumer” pursuant to Legislative Decree No. 206/2005 (the “Consumer Code”).
Consumers are in all cases entitled to the mandatory rights provided for by applicable law. Any terms reserved for professional customers may not limit those rights.
2. Seller information and contact details
The seller of Products purchased online is SAN PIETRO S.P.A., with registered office at VIA LAURITO, 2 - 84017 POSITANO (SA), ITALY, VAT No. and Tax Code 02394820654, REA SA-220791. For information about the e-commerce service, the support channels indicated on the Website may be used; unless a different dedicated contact is provided, laboutique@ilsanpietro.it is available.

3. Product characteristics
The essential characteristics of each Product are set out on the relevant product page. Images are for illustrative purposes and, due to device settings or artisanal manufacturing processes, colours, grain patterns, embroidery, prints, finishes and minor irregularities may vary from what is displayed online.
Where such variations are inherent to artisanal workmanship and do not affect the Product’s conformity with its description and intended use, they do not in themselves constitute a defect. The Consumer’s rights in the event of an actual lack of conformity remain unaffected.
Where applicable and to the extent that the relevant information is made available by the manufacturer or supplier, the product page also provides the applicable pre-contractual information concerning durability, repairability, the availability and ordering procedure for spare parts, repair and maintenance instructions, and restrictions on repair.
4. Availability and sales destinations
Availability shown on the Website is updated with the greatest care, but overlapping orders or inventory errors may occur. If a Product is no longer available after the order has been submitted, the Customer will be informed without undue delay and any amounts already collected for the unavailable Product will be refunded.
The destinations served and any territorial restrictions or restrictions relating to specific product categories are shown during checkout. The Seller may decline orders destined for countries or territories not served by the carrier or subject to legal, customs or transport restrictions.
5. Prices, taxes, promotions and discount codes
Prices are expressed in the currency shown on the Website and, for sales to which it applies, include VAT. Before submitting the order, the Customer is shown the price of the Products, any discounts, shipping charges and other applicable costs.
For shipments to countries outside the EU, any duties, import taxes and customs charges may be included in the final amount or requested from the recipient upon import, as indicated at checkout and in the order confirmation. The Customer is responsible for any charges not included in the total paid to the Seller.
Promotions and discount codes are subject to the terms communicated for the relevant initiative and, unless otherwise stated, cannot be combined. Where a price reduction is announced, the previous price is indicated in accordance with applicable law.
In the event of a manifest and recognisable pricing error, the Seller will inform the Customer before processing the order and allow the Customer either to confirm the purchase at the correct price or cancel it with a full refund of any amounts already collected.
6. Ordering procedure and conclusion of the contract
1. The Customer selects the Products and adds them to the shopping cart.
2. Before purchasing, the Customer checks the order summary, delivery address, shipping method, total price and any additional charges.
3. The Customer accepts these Terms and submits the order using the button or command that clearly indicates the obligation to pay.
Before the order is submitted, where applicable to the Product purchased, the Customer also receives, in a clear and prominent manner, information regarding any manufacturer’s commercial durability guarantee subject to the harmonised GARAN label, in accordance with the legislation in force from 27 September 2026.
4. The Seller sends an electronic acknowledgement of receipt of the order. The contract is deemed concluded when the Seller sends the order confirmation accepting the purchase, unless expressly stated otherwise in the checkout process.
Before the contract is concluded, the Seller may decline the order in the event of unavailability, inability to verify or authorise payment, reasonable suspicion of fraud, a manifest clerical error, legal restrictions or inability to deliver to the stated destination. In such cases, any amounts already collected will be refunded. After the contract has been concluded, any suspension, termination or other consequences may apply only in the cases provided for by these Terms or by applicable law.
7. Payments
The payment methods available are shown at checkout and may include payment cards, digital wallets or other services operated by third-party providers. Payment data is processed in accordance with the security standards of the respective service providers; the Seller receives only the information necessary to manage the transaction and the order.
Depending on the method selected, the amount may be pre-authorised, charged when the order is placed or charged when the order is processed. If payment is not authorised or is subsequently reversed, the Seller may suspend or cancel the order.
8. Shipping and delivery
Products are delivered by courier to the address provided by the Customer. The delivery methods, any costs and the date or time limit by which the Seller undertakes to make delivery are indicated to the Customer at checkout and/or in the order confirmation, in accordance with applicable law. The Shipping and Delivery Policy published on the Website contains further operational information.
Where delivery options with specific environmental characteristics are available, they are indicated at checkout together with the relevant conditions, costs and delivery times.
Free shipping over €500. Standard shipping is free when the total value of the Products in the order, calculated after applying discounts or promotional codes and before any shipping charges, exceeds €500. For orders with a value of €500 or less, the charges shown at checkout apply.
Any operational estimates provided by the carrier may vary depending on the destination, peak-season periods, customs checks or events not attributable to the Seller, without prejudice to the delivery date or time limit communicated to the Customer and the remedies provided for by applicable law. Unless otherwise agreed, delivery to Consumers will take place without undue delay and in any event within the maximum period provided by law.
The risk of loss of or damage to the Products passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Products, except where the carrier was independently chosen by the Consumer and was not proposed by the Seller.
Upon delivery, Customers are advised to check the integrity of the package and, if there is visible damage, to note a reservation with the courier and promptly contact Customer Care. Failure to note a reservation with the courier does not affect the Consumer’s mandatory rights.
9. Order cancellation before shipment
The Customer may contact Customer Care to request cancellation of an order that has not yet been processed. The Seller will make reasonable efforts to accommodate the request but cannot guarantee cancellation if preparation or shipment has already begun. Consumers’ statutory right of withdrawal remains unaffected.
10. Right of withdrawal and returns
The Consumer may withdraw from the contract without giving any reason within 14 days from the day on which the Consumer acquires physical possession of the Products or, in the case of multiple goods delivered separately under a single order, from the day on which the Consumer acquires physical possession of the last item.
The operational procedure, Product conditions, statutory exclusions, return costs and refund timeframes are described in the “Return and Refund Policy” published on the Website, which supplements these Terms.
11. Legal guarantee of conformity and harmonised notice
Products sold to Consumers are covered by the legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code. For new goods, the Seller is liable for any lack of conformity existing at the time of delivery and becoming apparent within two years of delivery, without prejudice to any further rights provided by law.
In the event of a lack of conformity, the Consumer is entitled, in the cases and according to the hierarchy provided by law, to have conformity restored by repair or replacement free of charge, or to a proportionate reduction in the price or termination of the contract.
The guarantee does not cover deterioration resulting from normal wear and tear, improper use, washing or maintenance not in accordance with instructions, alterations or damage caused by the Customer, it being understood that the Seller may not exclude or limit the Consumer’s mandatory rights.
From 27 September 2026, the Seller informs the Consumer of the main elements of the legal guarantee of conformity by means of the harmonised notice provided for by Article 65-ter of the Consumer Code and Implementing Regulation (EU) 2025/1960. The official notice is made visibly available on the Website in the format required by law and, for the online interface, in colour.
The elements of the harmonised notice may not be modified. The related information notice is separate from these Terms and supplements the pre-contractual information provided to the Consumer without replacing or limiting the rights recognised by law.
Where the manufacturer of a Product offers, at no additional cost, a commercial durability guarantee covering the goods as a whole for a period exceeding two years and makes that information available to the Seller, the Website informs the Consumer of the existence and duration of that guarantee by means of the harmonised GARAN label. This commercial guarantee operates independently of the legal guarantee of conformity.
12. Damaged, defective or incorrect Products
If the Product received is damaged, defective or different from the one ordered, the Customer is invited to contact Customer Care, stating the order number and, where possible, attaching photographs useful for verification. The Seller will provide instructions for collection, return, replacement or refund in accordance with applicable law.
Where the issue constitutes a lack of conformity, the remedies and related hierarchy set out in Article 11 of these Terms and in the Consumer Code apply.
The costs necessary to return a Product recognised as defective, damaged or sent in error are borne by the Seller.
13. Failed delivery, incorrect addresses and refusal of the package
The Customer must provide a complete and correct address and be available for delivery in accordance with the carrier’s procedures. In the event of an uncollected package, an incorrect address or refused delivery, the Customer is invited to contact Customer Care promptly. Refusing delivery or failing to take delivery does not automatically amount to exercising the right of withdrawal and does not, in itself, result in the loss of that right.
If the package is returned to the Seller, any refund will be processed after receipt and inspection of the Products. Any documented costs directly caused by the failed delivery may be charged or deducted only if and to the extent permitted by applicable law.
14. Liability
To the fullest extent permitted by law, the Seller is not liable for indirect or unforeseeable losses or damage, or losses or damage not causally connected with a breach by the Seller. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, or any mandatory rights of Consumers.
The Seller is not responsible for delays or impediments caused by events beyond its reasonable control, including natural events, transport disruptions, strikes, measures by public authorities, customs restrictions, or unavailability of networks or payment services, subject to the obligation to take reasonable measures to limit their effects.
For international shipments, the Customer must check any local prohibitions or restrictions relating to the import, possession or use of the Products in the destination country, insofar as such checks are not among the Seller’s statutory obligations. The Seller is not liable for consequences arising from local prohibitions or restrictions that could not reasonably have been known and are not attributable to its conduct, without prejudice to obligations and liabilities that cannot be excluded or limited by law.
15. Intellectual property and use of the Website
Trade marks, logos, photographs, graphics, texts, patterns, designs, collections and content on the Website are protected by intellectual and industrial property laws. They may not be used, reproduced, distributed or exploited for commercial purposes without the prior authorisation of the holder of the relevant rights.
16. Personal data
Personal data is processed in accordance with applicable law and the Privacy Policy and Cookie Policy published on the Website. Those policies govern, among other matters, the purposes of processing, legal bases, retention periods and the rights of data subjects.
17. Amendments to the Terms
The Seller may update these Terms for regulatory, technical or commercial reasons. The version applicable to each order is the version made available to and accepted by the Customer when the order is submitted. Subsequent amendments do not affect contracts already concluded, except where required by mandatory law.
This version is prepared for orders concluded from 27 September 2026 and takes into account the information obligations introduced by Legislative Decree No. 30 of 20 February 2026 and Implementing Regulation (EU) 2025/1960, without prejudice to the application of any subsequent mandatory provisions.
18. Governing law, complaints and disputes
These Terms are governed by Italian law. For Consumers, this choice does not prejudice any mandatory protections granted by the law that would apply in the absence of such choice. For disputes with Professional Customers, the Courts of Salerno shall have exclusive jurisdiction, unless otherwise provided by mandatory law. For disputes with Consumers, jurisdiction and venue are determined by the applicable mandatory rules.
Before commencing legal proceedings, the Customer is invited to contact Customer Care to allow an amicable solution to be sought.
If a complaint submitted directly by the Consumer cannot be resolved, San Pietro S.p.A. will provide the Consumer, on a durable medium, with information regarding the competent alternative dispute resolution (ADR) bodies, specifying whether it intends to use such bodies to resolve the dispute.
Recourse to an ADR procedure does not in any event prejudice the Consumer’s right to bring the matter before the competent judicial authority, in the cases and according to the procedures provided for by applicable law.
The European online dispute resolution platform (ODR platform) has been discontinued and is no longer operational.
19. Final provisions
The nullity or ineffectiveness of any individual provision does not result in the nullity of the remaining Terms, which will continue to be effective to the extent permitted by law. Any failure to exercise a right does not constitute a waiver of that right.
If these Terms are also made available in other languages, the Italian version constitutes the reference text, without prejudice to the Consumer’s mandatory rights and the rules applicable in the destination country.
